It applies to our website, our Circle community, our social media pages, our programs, memberships, digital products, supplement dispensary, and nutrition services. Please read it carefully. By using our website or purchasing anything from us, you agree to everything on this page.

Part 1. Who We Are
Our services are offered under the name Nourish Center (also referred to as The Nourish Center) by the following businesses (each a "Provider"):

Nutrition By Shanon PLLC, a New York professional limited liability company doing business as Nourish Center. Nutrition By Shanon PLLC provides individualized nutrition services, including nutrition assessments, nutrition counseling, and medical nutrition therapy ("Clinical Services"). It may also offer programs, memberships, and digital products.

Nourish Center, an earlier business owned by Shanon Whittingham that operated under the Nourish Center name before Nutrition By Shanon PLLC was formed, and that continues to offer educational programs, group coaching, memberships, meal plans, digital downloads, online content, and community spaces ("Programs").
Clinical Services are provided only by Nutrition By Shanon PLLC. No other business provides clinical or medical nutrition services under the Nourish Center name.
Your receipt, invoice, or account will show which Provider you purchased from. Each Provider is responsible only for the services and products it provides. In this document, "we," "us," and "our" mean the Provider you are dealing with, and this page applies equally to each Provider. "You" and "your" mean anyone who visits our website, joins our community, or uses our services.
NOURISH CENTER® is a registered trademark of Shanon Whittingham and is used by the Providers with her permission.
Our business is based in Brooklyn, New York.
Part 2. Health & Medical Disclaimer
Educational Information Only
All content on our website, in our emails, social media, Circle community, blog posts, videos, recipes, meal plans, guides, Programs, and memberships is for general educational and informational purposes only. It is not medical advice and is not a substitute for individualized care from a qualified healthcare professional.
Reading our content, joining a membership, buying a meal plan, joining our Circle community, attending a group program, or contacting us by email or social media does not create a dietitian-client or other healthcare provider relationship. A provider relationship with Nutrition By Shanon PLLC exists only after you complete our intake process in Practice Better, sign our client agreement and consent forms, and are accepted as an individual client.
Not a Diagnosis or Treatment
We do not diagnose, treat, cure, or prevent any disease through our website, community, or Programs. Our content is not intended to replace or conflict with any treatment, medication, or advice given to you by your physician or other healthcare provider.
Always talk with your physician before starting a new eating plan, exercise routine, fast, cleanse, or supplement, and before making any change to a medication. This is especially important if you are pregnant or breastfeeding, have a medical condition, have or have had an eating disorder, take prescription medications, or are under 18.
Never disregard professional medical advice or delay seeking it because of something you read, watched, or received from us.
Emergencies
We do not provide emergency services, and our messages, emails, client portal, and Circle community are not monitored around the clock. If you are having a medical emergency, call 911 or go to the nearest emergency room. If you are in emotional crisis or having thoughts of harming yourself, call or text 988 (Suicide & Crisis Lifeline).
Individual Results Vary
Every body is different. Results depend on many factors, including your health history, genetics, consistency, and other circumstances outside our control. We cannot and do not guarantee any specific outcome, including weight change, lab values, symptom relief, or health improvement.
Holistic & Integrative Approaches
Some of our content discusses holistic, integrative, or functional nutrition approaches. Some of these approaches may have limited scientific research behind them or may not be accepted by all healthcare professionals. We will try to tell you when that is the case. Please discuss any approach with your physician before using it.
Accuracy of Information
We take care to share accurate, up-to-date, and evidence-informed information, but nutrition science changes over time, and we cannot guarantee that every piece of content is complete, current, or error-free. If we mention a product, verify details such as ingredients, pricing, and availability directly with the manufacturer or seller, because this information can change and may differ by location.
Credentials & Location
Clinical Services are provided by Shanon Whittingham and any other qualified nutrition professionals who work with the practice, including supervised students or interns when you have been told in advance. Credential and certification information is available on request. Individual Clinical Services, including telehealth sessions, are offered only to clients located in New York and in other places where we are legally permitted to provide them. You agree to tell us accurately where you will be physically located during each session.
Part 3. Terms of Use
3.1 Agreement to These Terms
These Terms of Use, together with the rest of this Legal Center page (all together, the "Agreement"), govern your use of our website, community, and services. We may update this Agreement from time to time by posting a new version with a new Effective Date. Your continued use of our website or services after an update means you accept the updated version. If you have an active paid membership, we will notify you of any material changes to your membership terms as described in Part 4.
If you sign an individual client agreement, informed consent, or similar document with Nutrition By Shanon PLLC, that signed document controls if it conflicts with this page.
3.2 Eligibility
You must be at least 18 years old to use our website, create an account, join our Circle community, or make a purchase. A parent or legal guardian may purchase services for a minor and must consent to and participate in services for that minor as we require.
3.3 Permission to Use Our Website
We give you a limited, personal, non-exclusive, non-transferable, revocable permission to use our website and content for your own personal, non-commercial use, in line with this Agreement. You use our website at your own risk. We may change, suspend, or discontinue any part of the website or community at any time.
3.4 Things You May Not Do
You agree not to, and not to help anyone else to:

Copy, sell, share, resell, or redistribute our content, Programs, meal plans, or downloads (including sharing your login or files with people who did not purchase them).

Use our content to create a competing product, program, or website.

Violate anyone's privacy, publicity, copyright, trademark, or other rights.

Post or send spam, advertising, or solicitations without our permission.

Upload viruses or harmful code, or try to hack, scrape, copy, or reverse engineer our website or community.

Harass, threaten, or abuse anyone.

Break any applicable law.
3.5 Your Content
"Your Content" means anything you post, upload, or send to us or in our Circle community, such as comments, photos, reviews, and messages. You keep ownership of Your Content. By posting it in the community, you give us a non-exclusive, royalty-free permission to display it in that space and to remove it at any time. We will not use your name, photo, story, or testimonial in our marketing unless you give us separate written permission.
You are responsible for Your Content and confirm that you have the right to share it.
3.6 Feedback and Ideas
If you send us suggestions, ideas, or feedback about our business, we may use them without paying or crediting you. This does not apply to your personal or health information, which we protect as described in Part 5.
3.7 Platforms We Use
We use trusted third-party platforms to run our business:

Wix for our website, online store, and some purchases.

Practice Better for our client portal, scheduling, intake forms, client records, messaging, and payments for Clinical Services and some programs.

Circle (circle.so) for our online community and some memberships and courses.

Fullscript for our professional supplement dispensary.

Practice Better video and Zoom for telehealth sessions and live group calls. We use HIPAA-compliant settings for individual telehealth sessions.
These platforms have their own terms and privacy policies, and they process payments through their own payment processors. We do not control them and are not responsible for their content, outages, or practices. Please review their terms and privacy policies. Mentioning these platforms does not mean they endorse us.
3.8 Errors and Changes
Our website may sometimes contain typos or errors, including in pricing or descriptions. We may correct errors, update information, and cancel orders affected by a clear error at any time, including after you place an order. If we cancel your order because of our error, we will refund what you paid for that order.
3.9 Termination of Access
We may suspend or end your access to our website, Circle community, or Programs if you violate this Agreement or act in a way that harms other members or our business. If we end your access without a violation on your part, we will refund any unused prepaid amount for that service.
3.10 No Warranties
To the fullest extent allowed by law, our website, content, community, and Programs are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that our website or community will be uninterrupted, secure, or free of errors or viruses.
3.11 Limitation of Liability
To the fullest extent allowed by law, the Providers and their owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of our website, content, community, or Programs.
To the fullest extent allowed by law, a Provider's total liability to you for any claim related to our website, content, community, or Programs will not exceed the amount you paid that Provider in the three (3) months before the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
Nothing in this Agreement limits any liability that cannot be limited under New York or federal law, including liability for gross negligence, willful misconduct, or fraud, and nothing in this Agreement limits any rights you have as a client that cannot be waived.
3.12 Indemnification
You agree to defend and hold harmless the Providers and their owners, employees, and contractors from claims, losses, and reasonable attorney's fees caused by your violation of this Agreement, your misuse of our website, community, or content, or your violation of someone else's rights.
Part 4. Purchases, Memberships, Appointments & Refunds
4.1 Prices and Payment
Prices are listed on our website or provided to you before purchase. Depending on what you buy, your payment is processed through Wix, Practice Better, Circle, or Fullscript, each using its own secure payment processor. We do not see or store your full card number. By purchasing, you confirm that you are authorized to use your payment method.
4.2 When Your Program Starts
Digital Programs and memberships begin as soon as you sign up and your payment is processed. You may begin working through the material whenever you are ready.
4.3 Memberships and Automatic Renewal
Some memberships, packages, and plans renew automatically until you cancel. Before you purchase, we will clearly show you the price, how often you will be charged, and how to cancel. By purchasing a recurring membership or plan, you agree that we may charge your payment method at the start of each billing period, at the then-current price, until you cancel.

Confirmation: After you sign up, you will receive a confirmation that you can keep, showing the renewal terms, price, billing frequency, the deadline to cancel before the next charge, and how to cancel.

How to cancel: You can cancel at any time on the platform where you signed up: in your Circle account settings for Circle memberships, in your Practice Better client portal for packages and programs purchased there, or in your Wix member account for plans purchased on our website. You can also always cancel by emailing info@nourishcenter.com with the subject line "Cancel." If you signed up online, you can cancel online. Your cancellation stops future charges, and you keep access through the end of the period you already paid for.

Annual plans: If you have a plan of one year or longer, we will remind you at least 15 days (and no more than 45 days) before your cancellation deadline.

Free trials: If an offer includes a free trial, we will tell you the price that applies when the trial ends, and you may cancel before you are charged.
-
Price changes: We will give you clear notice of any price increase or other material change at least five (5) business days before it takes effect, so you can cancel first.
4.4 Appointments, Cancellations & Rescheduling (Clinical Services)
We set aside time just for you, and we often maintain a waitlist. When an appointment is missed without notice, that time cannot be offered to another client.

Please cancel or reschedule at least 24 hours before your appointment in your Practice Better client portal or by sending us a message there.
-
For Monday appointments, we encourage you to cancel or reschedule by 12:00 p.m. (noon) on the Friday before, since our office is closed on weekends.

If something comes up and you can't give 24 hours' notice, please let us know as soon as you can.

Full details are in the Client Agreement & Informed Consent you sign at intake.

A $75 fee applies to appointments that are missed, canceled, or rescheduled with less than 24 hours' notice. It is charged to the card on file in Practice Better. Insurance does not cover this fee.

Repeated missed appointments may result in a change to your scheduling privileges or a pause in services.
4.5 Discontinuing Services
If you decide our services are not the right fit, you may stop at any time by canceling in your account or by messaging us in your Practice Better client portal. There is no termination fee.
4.6 Refund Policy

Sessions and Programs: Fees for sessions already held and Program or membership periods already started are non-refundable, except where required by law.

Meal plans and digital downloads: All meal plans (including meals and snacks), guides, and other digital downloads are delivered instantly. Because they cannot be "returned," all sales of digital products are final once purchased and accessed, except where required by law.

Supplements: Supplements ordered through Fullscript are shipped and handled by Fullscript. Returns, refunds, shipping issues, and autoship changes are handled under Fullscript's policies and through your Fullscript account.

Billing errors: If you believe you were charged in error, contact us within 30 days and we will review and correct any error.
4.7 FSA, HSA & Receipts
Many clients use Flexible Spending Account (FSA) or Health Savings Account (HSA) funds to pay for sessions and programs. Eligibility is decided by your plan administrator, not by us, so please check with your FSA/HSA provider. We are happy to provide receipts or other documentation you may need, but we cannot guarantee that any expense will be approved.
4.8 Health Insurance & Self-Pay Rates
We accept certain insurance plans for Clinical Services. Before your first appointment, we verify whether your plan is accepted and covers nutrition services. If your plan is not accepted, we will let you know, and you can choose to continue at the self-pay rate. We cannot guarantee coverage. You are responsible for any copays, coinsurance, deductibles, and services your plan does not cover.
Current self-pay rates for individual sessions:

55-minute session: $225

40-minute session: $175

30-minute session: $125
Rates may change, and the current rate will always be shown before you book. Insurance does not cover Programs, memberships, digital products, supplements, or late cancellation fees.
Part 5. Privacy Policy & Health Data Protections
Your health information is personal, and we treat it that way. This Privacy Policy explains what we collect, how we use it, and the choices and rights you have. We hold ourselves to a higher standard than many wellness businesses: the protections in this Part apply to everyone who uses our services, wherever they live.
5.1 Our Privacy Promises

We never sell your personal information or your health information. Not for money, not in exchange for anything else.

We never use your health information for advertising, and we do not let advertising companies collect it.

We collect only what we need to provide the services you ask for.

We ask for your separate permission before using your health information for anything beyond providing the services you requested.

You can see, download, or delete your information at any time, as described below.
5.2 What We Mean by "Health Information"
"Health Information" means any information that identifies you, or could reasonably be linked to you, and relates to your past, present, or future physical or mental health. This includes things like health conditions and diagnoses, symptoms, medications, supplements, lab results, food and eating habits, weight and body measurements, reproductive or sexual health, information from intake forms and questionnaires, biometric or genetic data, location information that shows you are seeking health services, and anything we could infer about your health from other information.
5.3 Your Client Records
If you become a client of Nutrition By Shanon PLLC, your client record is protected health information under the federal HIPAA law. It is stored in Practice Better, a secure, HIPAA-compliant client portal and records system. How we use and share client health records, and your rights over them, are explained in our separate Notice of Privacy Practices at nourishcenter.com/privacy-practices, which we also give you at intake. If this Privacy Policy and the Notice of Privacy Practices ever conflict about your client records, the Notice of Privacy Practices controls.
Please do not send detailed health information through our website contact form, social media messages, the Circle community, or regular email. Use your secure Practice Better client portal instead.
5.4 Information We Collect

Information you give us: such as your name, email address, phone number, mailing address, intake forms, questionnaire answers, survey responses, and messages.

Purchase information: what you bought, when, and on which platform. Your card details are handled by the payment processor of the platform you used (Wix, Practice Better, Circle, or Fullscript).

Supplement orders: if you order through our Fullscript dispensary, Fullscript shares order information with us (such as the products you ordered) so we can support your care plan.

Community information: your Circle profile and what you post in our community.
-
Website usage information: collected automatically when you visit our website, such as IP address, browser and device type, pages visited, and referring pages.

Approximate location: based on your IP address or what you tell us, used for time zones and to confirm our services are available where you are. We do not collect precise location data.
5.5 How We Use Your Information
We use your information only to:

Provide, schedule, and manage the services, Programs, memberships, and products you request.

Process payments and send receipts, confirmations, and account notices.

Respond to your questions and messages.

Keep our website, community, and records secure, prevent fraud, and comply with the law.

Understand how our website is used so we can improve it, using information that does not include your Health Information.

Send newsletters and marketing emails if you sign up or are a customer (you can unsubscribe anytime). We never use your Health Information to decide what marketing you receive unless you give us separate written permission.
5.6 Your Permission Comes First
If we ever want to use or share your Health Information for any purpose other than providing the services you requested (for example, to feature your story, use your results in marketing, or share information with someone you name), we will ask you first in a separate written authorization. That authorization will:

Be separate from our other terms, forms, and checkout pages.

Explain exactly what information is involved, why, and who will receive it.

Expire within one (1) year unless you renew it.

Be easy to cancel at any time by emailing info@nourishcenter.com or messaging us in your client portal.
Saying no will never affect your price, the quality of your care, or your access to our services.
5.7 How We Share Information
We share information only:

With service providers who help us run our business, such as Wix, Practice Better, Circle, Fullscript, our email marketing service, and payment processors. They may use your information only to provide services to us, and we choose providers that keep it confidential and secure.

With your written permission, such as when you ask us to coordinate with your physician.

When required by law, court order, or legal process, or when needed to protect someone's health or safety.

If our business is sold or transferred, in which case the new owner must honor this Privacy Policy, and Health Information will be transferred only as allowed by law.
5.8 Cookies, Analytics & No Health Tracking
Our website uses cookies and similar technologies to make the site work, remember your preferences, and understand how visitors use it, through tools such as Wix's built-in analytics and Google Analytics. We follow these rules:

We do not place advertising pixels or tracking tools (such as the Meta Pixel) on our client portal, intake forms, health questionnaires, or appointment booking pages.

We do not share Health Information with analytics or advertising companies, and we do not allow them to build health profiles about you from our website.

If we use advertising cookies on general pages of our website (such as our blog or homepage), we will ask for your consent through a cookie notice first, and you can decline.
You can also control cookies in your browser settings and opt out of Google Analytics at tools.google.com/dlpage/gaoptout.
5.9 Our Circle Community
Our community is hosted on Circle (circle.so). Anything you post in the community, including your profile, posts, comments, and photos, can be seen by other members. Your use of Circle is also covered by Circle's own terms and privacy policy. We do not control what other members do with information you share, so please think carefully before sharing personal or health information in the community. We do not use community posts for marketing without your separate written permission. See Part 8 for community guidelines.
5.10 How We Protect Your Information
We use reasonable administrative, technical, and physical safeguards to protect your information, as required by New York law, including secure platforms, password protection, and limiting access to people who need it to serve you. No system is completely secure, so we cannot guarantee absolute security. Regular email is not a secure way to send sensitive information. If a data breach affecting your personal information occurs, we will notify you as required by law.
5.11 How Long We Keep Information
We keep personal information only as long as needed for the purpose you gave it to us. When Health Information is no longer needed for that purpose, we delete or securely destroy it within 60 days, except for information we are required to keep by law or professional standards, such as client health records, tax and payment records, and records needed to resolve disputes. Client health records are kept for at least six (6) years after your last session, and for minors, until at least one year after they turn 21, whichever is later. Records are then securely destroyed.
5.12 Your Rights
You have the right to:

Access and download the personal and Health Information we hold about you.

Correct information that is inaccurate.

Delete your personal and Health Information and close your account.
-
Withdraw any permission (authorization) you previously gave us.

Unsubscribe from marketing at any time.
To make a request, email info@nourishcenter.com or message us in your client portal. We will respond within 30 days. We may need to confirm your identity first. Some information, such as client health records and payment records, may need to be kept for legal reasons even if you ask us to delete it, and we will tell you if that applies. We will never treat you differently for exercising these rights.
5.13 Employer-Sponsored Programs
If your employer or another organization pays for you to use our services, your participation is voluntary. We never share your individual health information, session content, intake answers, or individual attendance with your employer unless you give us separate written permission or the law requires it. Employers receive only combined, de-identified summaries (such as total workshop attendance), and never for groups small enough to identify you. If you start individual sessions through an employer program, your provider-client relationship is with us, not your employer.
5.14 Children's Privacy
Our website and community are not directed to children under 13, and we do not knowingly collect personal information from children under 13 online. If you believe a child has given us personal information, contact us and we will delete it. Services for minors are arranged only through a parent or guardian.
5.15 Visitors Outside the United States
Our website is operated in the United States and is intended for U.S. visitors. If you use it from another country, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
5.16 Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to keep up with new privacy laws. We will post the updated version on this page with a new Effective Date. If a change would allow us to use Health Information in a new way, we will ask for your permission first.
Part 6. Email & Text Message Policy
6.1 Email
When you join our email list, purchase from us, or become a client, we may send you newsletters, educational content, and offers. In line with the federal CAN-SPAM Act, we will:

Never use false or misleading subject lines or sender names.

Identify promotional emails as advertisements in a reasonable way.

Include our mailing address in every marketing email: 2918 Avenue I, Suite 1350, Brooklyn, NY 11210.

Include an unsubscribe link in every marketing email and honor requests promptly (within 10 business days).
You may unsubscribe at any time by clicking the link at the bottom of any email or by emailing info@nourishcenter.com. Even after you unsubscribe from marketing, we may still send you messages related to your account, purchases, or appointments.
6.2 Text Messages
If you give us your mobile number, we send appointment reminders and service-related messages through Practice Better. You can turn reminders off in your Practice Better settings or by replying STOP. We will send marketing texts only if you give separate, express written consent, and consent is never required to purchase anything. Message frequency varies. Message and data rates may apply. Reply STOP to stop texts or HELP for help. We never sell or share your mobile number for others' marketing.
Part 7. Disclosures: Affiliates, Supplements & Testimonials
7.1 Our Commitment to Honesty
Everything we share reflects our honest findings, opinions, beliefs, or experience. Loyalty to our clients and community comes first, and we will not compromise this honesty under any circumstances.
7.2 Affiliate Links and Partnerships
Some links on our website, emails, community, or social media may be affiliate links, which means we may earn a commission if you buy through them, at no extra cost to you. We may also receive free products or be paid to partner with brands. Whenever we have a financial or other material relationship with a company or brand we mention, we will clearly disclose it. Mentioning a product, brand, or company does not mean it endorses us or that we are affiliated with it, unless we say so.
7.3 Dietary Supplements & Our Fullscript Dispensary
We offer professional-grade supplements through our Fullscript dispensary. We may earn income from supplements purchased through our dispensary. We recommend products based on what we believe is best for you, and you are never required to buy supplements from us, or at all, to receive our services. You are free to purchase any recommended product elsewhere.
Statements about dietary supplements have not been evaluated by the Food and Drug Administration. Supplements are not intended to diagnose, treat, cure, or prevent any disease. Talk with your physician before starting any supplement, especially if you take medications, are pregnant or breastfeeding, or have a medical condition.
7.4 Testimonials
Testimonials and client stories on our website reflect the real experiences of real people, shared with their written permission. They are not a promise or guarantee that you will get the same results. Individual results vary.
7.5 Advertising and Partnership Inquiries
If you are interested in advertising, partnering, or joining one of our programs, please contact us through our contact page.
Part 8. Circle Community Guidelines
Our online community on Circle is meant to be a supportive and respectful space. By joining, you agree to:

Be kind and respectful. No harassment, bullying, hate speech, or shaming of anyone's body, food choices, or health.

Keep what others share in the community private. Do not screenshot, copy, or share other members' posts, names, or photos outside the community.

Not post anything illegal, harmful, misleading, sexually explicit, or that violates someone else's rights.

Not sell, promote, or recruit for any business, product, or program, including in direct messages to other members, without our written permission.
-
Not post other people's private information (such as addresses, phone numbers, or financial details).
-
Understand that advice from other members is not professional advice, and community discussions are not individual nutrition care.
When you join, other members will be able to see your name, profile photo, and anything you post. We do not control what you or other members choose to share, and we cannot guarantee that other members will keep information private.
We may remove posts and remove or block members who break these guidelines, at our discretion. If something is reported to us, we may ask the member to edit or remove it within 24 hours before taking further action. If content appears to be illegal, we may report it to the proper authorities.
Part 9. Intellectual Property & Copyright (DMCA)
9.1 Our Content
All content on our website, in our community, and in our Programs, including text, recipes, meal plans, guides, graphics, photos, videos, audio, logos, and designs, is owned by the Providers, Shanon Whittingham, or their licensors and is protected by U.S. and international copyright, trademark, and other laws. NOURISH CENTER® is a registered trademark of Shanon Whittingham. THE NOURISH CENTER, NUTRITION BY SHANON, and our logos are also trademarks or trade names of their owners. None of them may be used without our written permission.
9.2 Sharing Our Content
We love when you share our work. You may not copy whole articles, meal plans, Program materials, full recipes, or images, or use our content for commercial purposes, without our written permission.
9.3 Copyright Complaints (DMCA)
We respect others' intellectual property. If you believe content on our website or community infringes your copyright, please send a written notice to our designated agent that includes:

Part 10. Disputes & General Legal Terms
10.1 Let's Talk First
If you have a concern or dispute with us, please email info@nourishcenter.com first. Most concerns can be resolved quickly this way. Both you and we agree to try in good faith to resolve any dispute informally for at least 30 days before starting any legal action.
10.2 Governing Law and Where Disputes Are Decided
This Agreement is governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that is not resolved informally will be decided exclusively in the state or federal courts located in Kings County (Brooklyn), New York, and you and we consent to those courts' jurisdiction. Either party may bring an eligible claim in small claims court instead.
10.3 Individual Claims Only
To the fullest extent allowed by law, you and we agree that any claim will be brought only on an individual basis, and not as a plaintiff or class member in any class action or representative proceeding.
10.4 Time Limit for Claims
To the fullest extent allowed by law, any claim related to our website, content, community, or Programs must be brought within one (1) year after it arises.
10.5 Our Relationship
This Agreement does not create any partnership, joint venture, employment, agency, or franchise relationship between you and us.
10.6 Other Terms

If any part of this Agreement is found unenforceable, it will be limited to the minimum extent necessary, and the rest will remain in effect.

Our failure to enforce any part of this Agreement is not a waiver of our right to enforce it later.

You may not transfer your rights under this Agreement. We may transfer ours to a successor business, including between the Providers.

Headings are for convenience only.

This Agreement, together with any signed client agreement or consent forms, is the entire agreement between you and us about its subject and replaces any earlier versions, including earlier terms, disclaimers, and policies posted by any Provider.

Sections that by their nature should continue after this Agreement ends (such as intellectual property, disclaimers, limitation of liability, indemnification, and disputes) will survive.
Part 11. Frequently Asked Questions
When does my program start?
As soon as you sign up and your payment is processed. Begin whenever you are ready. See Part 4.2.
How do I cancel or reschedule an appointment?
In your Practice Better client portal, at least 24 hours in advance, to avoid a $75 late cancellation fee. See Part 4.4.
How do I cancel my membership?
Anytime, on the platform where you signed up (Circle, Practice Better, or Wix), or by emailing info@nourishcenter.com. You keep access through the end of your paid period. See Part 4.3.
Can I get a refund?
Digital products and meal plans are final sale once purchased and accessed. Fees for sessions held and program periods already started are non-refundable. Supplement returns go through Fullscript. See Part 4.6.
Do you take insurance?
Yes, we accept certain plans and will verify yours before your first visit. Self-pay rates are listed in Part 4.8.
Can I use my FSA or HSA?
Many clients do. Check with your FSA/HSA provider, and we're happy to provide documentation. See Part 4.7.
Do you sell my information?
Never. We also never use your health information for advertising. See Part 5.1.
My employer is paying. Will they see my information?
No. Employers receive only combined, anonymous summaries, never your individual health information. See Part 5.13.
Is the Circle community private?
It is open only to members, but other members can see what you post. Please don't share sensitive health details there. See Parts 5.9 and 8.
